Once the child has been separated from their mother the Children Act 1989 does apply more generally and it provides a mechanism by which the state can offer support to this group of children. Section 17 of the Children Act 1989 gives local authorities the power to intervene in children’s lives:17(1) It shall be the general duty of every local authority (in addition to the other duties imposed on them by this Part)-

(a)to safeguard and promote the welfare of children within their area who are in need; and
